The Hermosa PD cops lied. No officer does a nystagmus test for drunk in public. A DUI, yes. PC 647F states the subject is to be so intoxicated that they cannot care for the safety of themselves, or others. A nystagmus test does not apply.

There is nothing preventing an officer from doing the HGN test on a drunk in public...if its good for DUI then why wouldnt it be useful in a public intox? You make no sense.

I understand your comment, but the criteria is different for DUI, vs. drunk in public. You could fail a HGN test miserably, but still not meet the criteria for drunk in public. Note the word drunk vs. under the influence. They are considerably different.

No one test is the endall solid proof in ANY case. The administration of a HGN test in any alcohol related arrest can prove usefull as ONE PIECE of the case. IE the defendant says I did not drink anything...the HGN result could dispute that. Nothing here the editing leaves us to wonder what other observations the arresting officer testified to. Did he have glassy eyes, slurred speech, staggard gait, poor dexterity, confused state of mind....the nystagmus test COULD have been the last observation

Those questions are contained in any drunk in public report, which is different than a DUI report. I'm telling you what existing law is. If you want to change the law, have your elected official ammend PC 647f. You're making an argument as to why the existing law should be changed, instead of understanding why the officer's only adhered to existing law and policy.

I have no dog in the fight, I dont live in California (anymore) so I have no reason to petition the legislature. Are you suggesting that PC 647(F) PROHIBITS the use of HGN? Not Also DUI and PI report formats are not dictated by "existing law". Do they not all have sections for narrative to explain their investigations? I must admit Im not a 100% on Hermosa PD dept policy but I doubt that they would prohibit the use of a lawful investigative tool (HGN) to butress a case other than a DUI.

I guess my question to you boils down to is why you think an alcoholic influence test CANT be used in this case..the statute you cite dosnt state it..policy maybe, but sensibly doubtful...can you back up your theroy of prohibition of HGN use, in all cases other than DUI with documentation? An HGN test would have changed what in this case? Did you know there is no blood, breath or urine test administered for 647f? That is what you should be asking for. Most 647f's are so drunk, they could not hold their heads straight long enough to do an HGN test; assuming they will even cooperate with the test. That is why a written report outlining the objective symptoms of alcoholic intoxication satisfies the criteria for 647f. Which they did write. We just haven't seen it.

Another thought; HGN can be used to help RULE OUT intoxication as well..a subject having a diabetic reaction can appear intoxicated but wont show nystagmus, nor will they register a BAC on a PBT...so if the officer was dispatched to investigate a report of a drunk walking down the street would you still suggest that due to his/her investigating PC 647(F) he/she CAN'T administer the test in this instance as well??

Again the HGN can counter the "I didnt drink nuthin" defense when used in CONJUNCTION with other observations. Also there's no prohibition in requesting the suspect consent to a search of blood/breath/urine...it's kinda a catch 22 though...if he/she can knowingly/inteligently consent then their likely not that intoxicated!

Also no doubt that the written report can satsfy the criteria...but why should the officer limit themselves if the subject is willing to perform the test...it can only help the officer's case in the long run. Also note that in a DUI investigation there is ZERO requriement for the driver to submit to the HGN or any other field sobriety test...PBT and Chemical tests later yes under "implied consent"

Correct, knowingly was the wrong word, I was getting at intoxicated people's cognative ability to intelignetly waive any right is questionable. I dont have any problem with an officer on the asking for and and acting on consent of an intoxicated person. Let the court supress it if it's wrong. The catch 22 i was getting at was if Im too drunk to intelegently waive my right and use that as an argument, Ive just admitted guilt so I shouldnt object, but now evidence of my guilt is admitted.
